This page explains our terms of service. When you use Reclub, you’re agreeing to all the rules.

1. Acceptance and Our Mission

Welcome to Reclub. Reclub is a Public Benefit Corporation (PBC) on a mission to unite the global sports community. We prioritize the health of our athletes and the strength of local sports communities. By using reclub.co (the “Site”) or the Reclub mobile application (the “App”), collectively referred to as the “Service,” you agree to these Terms.

This is a legally binding contract. If you do not agree to these Terms or our Privacy Policy, you must exit the Service. We may revise these documents at any time. Continued use of the Service after changes are published constitutes your acceptance of the revised Terms.

2. Sports Participation and Assumption of Risk

PLEASE READ CAREFULLY: PHYSICAL ACTIVITY INVOLVES INHERENT RISKS.

  • Inherent Risk: You acknowledge that participating in sports (including but not limited to pickleball, volleyball, football, and other recreational activities) involves inherent risks of serious physical injury, permanent disability, or death.
  • No Inspection: Reclub is a discovery platform, not a sports facility or league owner. We do not inspect, verify, or guarantee the safety of any physical venue, court, field, or equipment provided by club organizers or third parties.
  • Assumption of Risk: You voluntarily assume all risks associated with any "Meet," "Club," or event found via the Service. You are solely responsible for determining your physical fitness for play and for inspecting the safety of any venue before participating.

3. Neutral Venue and Organizer Relationship

Our Service is a neutral platform that allows sports enthusiasts to connect.

  • No Employment: Club organizers, coaches, and hosts are independent users and are not employees, agents, or partners of Reclub.
  • User Responsibility: Reclub does not background check users. You are responsible for taking adequate safety precautions when meeting someone in person through our Service.
  • No Endorsement: We do not endorse any particular user, club, or coach.

4. Club Payments and Receipt Uploads

To assist with community organization, the Service allows users to upload "Payment Receipts" to track shared expenses (e.g., court fees or club dues).

  • Off-Platform Transactions: All financial transactions occur strictly off-platform (e.g., via cash, Venmo, or other third-party services). Reclub is not a payment processor, escrow agent, or financial institution.
  • No Verification: Reclub does not verify the accuracy, authenticity, or legality of any uploaded receipt.
  • No Refunds: Because Reclub does not handle the funds, we have no mechanism to provide refunds or resolve payment disputes between users. Any disputes must be settled directly between the participant and the club organizer.

5. Fees and Subscriptions

The App is supported by advertising and premium "Supporter" subscriptions.

  • Premium Features: We offer subscription-based features (e.g., ad-removal, advanced analytics). Fees are indicated within the App.
  • Billing: Subscriptions are processed as "in-app" purchases via the Apple App Store or Google Play Store. Your billing relationship is with the respective App Store provider.
  • Renewals: Subscriptions automatically renew unless cancelled through your App Store account settings at least 24 hours before the period ends.
  • Refunds: All purchases are final. Refund requests must be directed to the Apple or Google Play Store.

6. Prohibited Activities

You agree not to engage in, or attempt to engage in, any of the following prohibited activities:

6.1 Behavioral Misconduct and Platform Integrity

  • Abuse & Harassment: Harassing, stalking, threatening, or defaming other users, or submitting content that promotes bigotry, hatred, or physical harm.
  • Deceptive Solicitation: Engaging in "social engineering" or fraudulent relationship-building for the purpose of financial scams (e.g., "pig butchering" scams, romance scams, or posing as another individual to solicit money or personal information).
  • Platform Poaching: Repeatedly promoting outside "Meets," events, or competing clubs within another club's message boards or "Moments" feed, especially where a Club Admin has expressed a desire to restrict such promotions.
  • Spam: Engaging in unauthorized commercial solicitations, "spam," or bulk messaging.

6.2 Data and API Misuse

  • Unauthorized Extraction: Using any automated process (including robots, spiders, or scrapers) or manual, human-assisted harvesting to monitor, "crawl," or copy Service content or data for any purpose.
  • API Restrictions: Accessing the Service through any undocumented API, or using any authorized API without express written permission from Reclub.
  • AI & Machine Learning: Using any Service content, statistics, or user data to train, tune, or inform any machine learning or artificial intelligence models.

6.3 Fraud and Deceptive Practices

  • Misrepresentation of Events: Creating "fake" Meets, clubs, or competitions for the purpose of financial profiteering or collecting user data under false pretences.
  • Charitable & Prize Fraud: Using the Service to organize charity tournaments, fundraisers, or prize-based competitions where the collected funds or prizes are not distributed to the stated recipients or causes.
  • Financial Misconduct: Using the Service to facilitate money laundering, credit card fraud, or unauthorized payment collections.
  • Account Integrity: Creating multiple accounts to circumvent bans, manipulate "Kudos" scores, or artificially inflate club popularity.

6.4 System Integrity

  • Reverse Engineering: Decompiling, reverse engineering, or attempting to derive the source code of the Software.
  • Circumvention: Bypassing any measures used to restrict access, including "robot.txt" files, IP blocking, or security features.
  • Infrastructure Burden: Engaging in any action that imposes an unreasonable or disproportionately large load on our infrastructure, as determined solely by Reclub.

6.5 Enforcement & Penalties

Reclub reserves the right, in its sole discretion, to investigate any report of a violation of these Terms. Users found engaging in prohibited activities may be subject to:

  • Warnings & Content Removal: Formal warnings or the immediate deletion of fraudulent/violating content.
  • Account Restrictions: Suspension or permanent banning of the user account and associated IP addresses.
  • Legal Action: Referral of fraudulent or illegal activities to relevant local law enforcement or regulatory authorities.

7. User Content and Location

  • Photos/Moments: By uploading photos to a Club or "Moments" feed, you grant Reclub a non-exclusive, royalty-free license to host and display that content for your community. You represent that you have the right to share these images.
  • Location Data: We track your location only while the App is open and in use to help you find nearby games. We do not track location in the background.

8. Intellectual Property and Data Ownership

8.1 Proprietary Rights: All Service contents—including but not limited to text, software, code, graphics, aggregated statistics, match history, user directories, club lists, 'Kudos' hierarchies, and the "look and feel" of the Service—are the exclusive property of Reclub PBC and are protected by international copyright, trademark, and database rights. The unique compilation and organization of all data on this platform is a proprietary trade secret of Reclub.

8.2 Strict Prohibition on Data Extraction: Except as provided in Section 8.3, you are strictly prohibited from extracting, harvesting, or reproducing any platform data, whether by automated means (such as "scraping") or otherwise. This prohibition applies regardless of intent and covers all commercial, competitive, "complimentary," or AI-training purposes.

8.3 Limited License for Club Admins: Reclub grants a limited, revocable license to designated Club Admins to use summary data or screenshots exclusively from their own managed club(s) for the following non-commercial purposes:

  • Club Promotion: Sharing screenshots of "Meets" or "Moments" to social media to showcase club activity.
  • Member Recruitment: Using club-specific stats to attract new players.
  • Internal Recognition: Compiling "top player" lists or activity summaries strictly for use within that specific club's community.

This license does not permit the use of data from other clubs, the bulk extraction of user directories, or the use of Reclub data in any third-party software. Any use exceeding these bounds requires express written permission.

8.4 Enforcement and Data Requests: Reclub reserves the right to determine what constitutes "unauthorized access." Any access exceeding "normal human use" is a violation of these terms. For data licensing or research inquiries, contact help@reclub.co with the subject line "DATA ACCESS REQUEST."

9. Disclaimer of Warranty; Limitation of Liability

THE SERVICE IS PROVIDED "AS IS." TO THE MAXIMUM EXTENT PERMITTED BY LAW, RECLUB DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING PROPERTY DAMAGE OR PHYSICAL INJURY, ARISING FROM YOUR USE OF THE SERVICE OR INTERACTIONS WITH OTHER USERS.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Florida. Any controversy or claim arising out of these Terms shall be settled by the courts located in St. Johns County, Florida.
